Man fatally shoots alleged intruder

March 15, 2007 12:07 AM

(ASHLAND, Ky.) -- An eastern Kentucky man fatally shot one of two alleged intruders who claimed to be police officers, according to sheriff's officials.

The other alleged intruder was arrested and charged with burglary and impersonating a police officer, a sheriff's report said.

Jason Daniels, 23, of Ashland, shot Robert Lewis Chapman, 50, of Greenup in the chest, shoulder and wrist on Wednesday night, the Boyd County Sheriff's office said in the report.

Adam C. Justice, 22, of Summitt, was lodged in the Boyd County jail.

Boyd County Sheriff Terry Keelin said the case would be turned over to the commonwealth's attorney and a grand jury would be asked to decide if any charges would be filed against Daniels.

The intruders allegedly broke into a home where Daniels was staying after Daniels refused to answer the door. The men had pounded on the door claiming to be police officers with a search warrant, Keelin said.

The men then allegedly forced Daniels into the bathroom, tied him up and proceeded to ransack the house, the sheriff's report said. While the alleged burglars were busy in other parts of the house, Daniels freed himself and got a 9 mm pistol from a cabinet, the report said.

"When the suspects returned to the bathroom, they found Mr. Daniels, now armed and in a shooting stance," the report said.

When one of the alleged intruders attempted to draw a revolver from its holster, Daniels fired four times and both men fled in a van that was parked nearby.

Chapman was dumped outside the emergency room entrance to Kings Daughters Medical Center about three miles from the scene of the incident and later died, the report said. Police stopped the van a few blocks from the hospital and arrested Justice.

Lesson learned:

This is yet another case of BGs impersonating police to prey on an otherwise law abiding and not in any trouble civilian. There was a discussion on this at OT dating from last fall where Diabolical talked about how this occurs and that the old lady in GA that shot back at cops as they illegally broke down her door was in her right to react fearfully firing first even as the plainclothed persons were in fact police. I agreed with him then and still do today, as did the grand jury that indicted those SOBs finding they had invaded her home illegally _and_ had done so on falsified pretense. Folks at OT jumped on his shit though saying such things do not occur but rarely like once in a blue moon. They were wrong, or rather uniformed, as this happens very often like twice a month as based on what I just happen to nitce in news reports during my own travels. It's not like I'm in law enforcement or the news trade either so I'm sure there are even more instances of as much beyond what I happen to pickup on. People are being victimized in their homes and on the streets by BGs in the persona of police, don't for a second believe this stuff occurs once in a blue moon.

you know fuzz - warrent or not

if i saw you sneaking through my catflap (not that i have one) we would have serious problems

the only thing that would be to your benefit would be your uniform

It's got a cop motor, a 440 cubic inch plant, it's got cop tires, cop suspensions, cop shocks. It's a model made before catalytic converters so it'll run good on regular gas. What do you say, is it the new Bluesmobile or what?

NASIOC OT was a huge time drain for me. Too much of a good thing.

it has really gone down hill recently - not nearly as entertaining as it once was years ago
