James Forrest Mobley was licensed to carry the .40-caliber Glock automatic he pulled from his lunch cooler and used to kill two people and himself after a dispute this month at the Best Buy construction site.

The 51-year-old Port Royal man was one of 53,738 South Carolinians granted concealed weapons permits by the State Law Enforcement Division since a law allowing the permits went into effect in 1996.

Mobley completed required training, a mental evaluation and a criminal background check, among other criteria, to qualify to carry the handgun.

It is the mental evaluation portion of the process that worries two of the area's top law enforcement officers most.

"The hardest part of concealed weapons permits or gun laws is the mental evaluation," said Beaufort County Sheriff P.J. Tanner. "I just conceivably can't figure out how we are honestly doing that in a proper way.

"There are a lot of folks who have mental disabilities that never show up on the radar screen. How do you know for sure?"

Mobley became irate after arguing with a painter and a general contractor over work space on the afternoon of May 10.

Within minutes, all three were dead.

Mobley shot Grady T. Bozeman, 65, the general contractor, and Rolando Matta, 37, the painter, a total of 14 times before shooting himself in the right temple. Investigators said Mobley opened fire after Bozeman called him "crazy."

Bluffton police Chief David McAllister believes the outcome might have been different if the weapon hadn't been so accessible.

"In my opinion ... I think given some time to cool off, the situation could have de-escalated," McAllister said. "The problem with guns is there's no time to cool off."

"The process should be much more rigorous as to who can carry weapons," he said. "As a police officer who's seen violent episodes a good portion of his career, guns don't do any good.

"I prefer the only gun involved in any situation is the one on the officer's belt."

INCREASING NUMBERS

The permit allows the holder to carry a weapon outside of designated prohibited areas such as schools, churches and jails.

The Best Buy site in greater Bluffton, where Mobley worked as an electrical subcontractor, was not among those prohibited areas.

Stafford Properties, the Georgia-based developer of Best Buy, could have prohibited guns on the property by posting signs, but didn't, workers said.

Since fiscal year 2003-04, the number of South Carolina residents issued permits has steadily increased -- from 9,820 to 16,713 in fiscal year 2005-06, according to SLED statistics.

Permits are rescinded from any holder charged with a felony or higher degree misdemeanor. Last year, 104 permits were rescinded. Sixty-one have been taken back so far this year, SLED said.

Tanner thinks the intent of conceal carry is to allow citizens to exercise their constitutional right to bear arms.

However, he couldn't recall a single incident when a permit carrying resident used a handgun in self-defense.

"I'm sure there were some that were carrying weapons anyway," he said. "I've arrested my share of people who were armed before concealed weapons permits, a lot of them while working narcotics."

In South Carolina, residents are allowed to carry handguns in their cars without permits as long as the weapons are stowed in the trunk or glove box.

One plus of the permits is that officers can know who is legally carrying weapons by accessing a state database.

McAllister and Tanner said most people with permits are forthcoming with officers whenever they're stopped on the road.

There is no cooling off time with a knife, hammer or fists, would it have been any different if this guy killed them by beating them over the head with a paint can?

Guns don't do any good, I have get to see one help an old lady across the street or donate it time to a soup kitcken. But then again I haven't seen a gun do anything since its an inanimate object...jackass

Example of as much has been in my local news as result of cooler heads not prevailing and employing feet, fists, a tire iron, and a beer mug. Maybe we should ban feet, fists, tire irons and mugs?!

Second arrest made in vicious beating in Amherst

AMHERST - A second man has been arrested and an arrest warrant has been sought for a third in connection with an Amherst beating.

Justin D. Etter, 22, of Brockton and a University of Massachusetts student, was arrested Saturday at 12:30 p.m. by Amherst police on a charge of assault and battery resulting in a serious bodily injury, police said.

They allege he participated in an attack on a 20-year-old Lynnfield man last Wednesday morning.

Police are also seeking Michael Vaz, 22, of Springfield on a charge of assault and battery resulting in serious bodily injury for his alleged role the incident, police said.

Lt. Ron Young said Monday that Vaz, who was a student at UMass, is at large and his whereabouts are unknown.

The first man charged in the case, Jason E. Becker, 22, of Burtonsville, Md., was arrested Wednesday at 1:06 p.m. at The Griggs, Unit 1, on charges of assault and battery to cause serious bodily injury and three counts of assault with a dangerous weapon (a metal pipe), police said.

Both Etter and Vaz were allegedly involved in the incident that took place at 2:14 a.m. outside the Griggs apartment building, 124 Amity St., where the Lynnfield man sustained multiple fractures to his head and a broken neck after being struck with a tire iron.

'They (Etter and Vaz) were involved in kicking and beating the victim once he was on the ground,' Young said.

Young said the assault didn't stop until after the victim was unconscious.

The assault apparently started as a road-rage incident in which two vehicles were trying to get into the same parking space near The Griggs.

After honking horns, people got out from their vehicles and Becker allegedly took a tire iron and struck the victim, and then continued to wave the tire iron at three other people in a threatening manner.

When the victim was already on the ground and bleeding, he was allegedly kicked by the other people, whom Becker had called to the scene using his cell phone.

The victim was also hit with a beer bottle, Young said, but police have not yet determined whether any of the suspects charged so far were responsible for that attack.

Becker was released to the custody of his parents following a dangerousness hearing Friday.

* Police are putting extra patrols at Brandywine Apartments after three residents told police Tuesday at 4:18 a.m. that a man was loitering in the area and acting in an odd manner. Police are unsure whether the man there was the same man who entered an apartment in December and got into a woman's bed while she was sleeping.

* A man who got into a verbal altercation with another man at the Amherst Brewing Co., 24 N. Pleasant St., Tuesday at 12:40 a.m. suffered cuts to his hand, arm and mouth after the other man threw a pint glass at him. The injured man didn't need medical attention while the other man fled in a limousine. Police are investigating.

Keep in mind this is just in quiet Amherst, MA where know nothing idiots from OT posts past have said nothing ever happens. Yeah really? The police and cop blotter very much disagree, weekly. Thats not to mention Northampton, Hadley, Easthampton, Belchertown, and the other surrounding small rural towns of W.MA where crime and criminals definitely do exist & reside.

fifty three THOUSAND CCW licenses, and one dude has to fuck the whole thing up.

however, imho, i agree with the above posts 100%. to think this mans anger fueled outburst was somehow inflamed by his posesion of a firearm is ridiculous. the man is at a construction site, the plethora of available sharp and blunt objects alike would have been more then adequately accessible to a "crazy" electrician. hell, the guy probably had a box cutter, a series of screwdrivers and probably a hammer ON his tool belt. he just happened to grab the one object he knew would work the best.
the man was willing to kill due to his frustration. i highly HIGHLY doubt the absence of his firearm would have made the least bit of difference.

besides, where does all this magical cool off time come from?

ASHTABULA - - A disgruntled customer at the Department of Motor Vehicles License Services on Lake Avenue kicked a can of white paint Tuesday, disrupting business for an hour or so, according to an Ashtabula Police Department report.

Police detectives nabbed the man, described as a 20-something city resident, at 11:15 a.m., shortly after the incident as he drove his vehicle south on West Avenue, near Griswold Road, the report said.

Police said the man's clothing was covered with white paint, as was the DMV's doorway and carpeting after other customers couldn't help but track it inside the lobby area.

The man will be charged with felony vandalism, police said.

Witnesses said the man came into the DMV at about 11 a.m. with a female friend. The couple wanted to get license plates. When they were told they would have to go to Jefferson for the plates, the man became upset and belligerent, witnesses told police.

The man repeatedly uttered profanities and deliberately kicked a can as he left the building, witnesses said. The can was holding the door of the office open.

The paint spewed all over the man's shoes and pants, the glass door, the sidewalk and windows, police said.

The man later told police he accidentally tripped over the can on his way out of the building, the report said.

This story has little to do with him carrying concealed legally. Hell, he stored it in his lunch box. It sounds to me like this was a little premeditated. We'll never know, but I think this would of happened even if he didn't have a CCW license.

Without the license, all he would of had to do is walk to his car.
